Terms of Use
The short version. APPTOMI gives you building blocks. You and an AI you choose make the tools and games. We don’t write them, check them or approve them, so they can be wrong, and you use them at your own risk. Never rely on one for your health, your safety, an emergency or money. The full terms below are what count.
These terms are an agreement between you and APPTOMI, a business registered in Israel (“we” or “us”), for using the APPTOMI app and this website. By using either, you agree to them. If you don’t agree, please don’t use APPTOMI.
1. What APPTOMI does
APPTOMI helps you make small tools and games (“mini-apps”) on your own phone with the help of an AI you choose: an AI chat app you already use, an AI provider you connect with your own key, or the AI on your phone. Mini-apps run inside APPTOMI on your device. How we handle data is set out in the Privacy Policy.
2. Who can use APPTOMI
- You must be at least 13 to use APPTOMI, or older if the law where you live requires it.
- If you are under 18, you need a parent or guardian to agree to these terms for you. Parents and guardians are responsible for what their children do in APPTOMI.
- The age check depends on what you or your phone tell us. It can be wrong, and we can’t promise that it keeps anything away from anyone.
3. A new app
- APPTOMI is new, and test versions come before release. It may have bugs, and features may change or be removed.
- Keep your own copy of anything important. Export apps you care about; we can’t restore data on your phone, and deleting APPTOMI deletes what is in it.
- Feedback you send us may be used to improve APPTOMI, without any obligation to you.
4. Free version and Unlimited
- Free version: you can keep up to 5 mini-apps you made and 3 from friends. The samples that come with APPTOMI don’t count.
- Unlimited: where we offer it, you can pay yearly or once. “Unlimited” means only this: we set no limit on how many mini-apps you can make and keep. The real limit is your phone, such as its free storage. It also turns on Friends.
- Friends has its own limit: the “Unlimited” name is not about Friends data. Each purchase can use our relay for up to about 1 GB a day. The relay is for networks that block a direct connection; past the limit, or when the relay is down, Friends works only where phones can connect directly. The AI you use and the other services you connect have their own limits too.
- Paying: Apple or Google sells it and takes the payment, at the price the store shows you. We never see your payment details.
- The yearly plan renews every year until you cancel it. Cancel in your Apple Account or Google Play subscriptions, at least a day before it renews. You keep Unlimited until the end of the year you paid for.
- The one-time purchase lasts for as long as we offer APPTOMI on your kind of phone. It is not a promise to run APPTOMI forever. If you get a new phone, restore it with the same Apple or Google account.
- Refunds and cancelling: ask Apple or Google, under their rules. This doesn’t take away any right you have under the consumer law where you live, including any right to cancel a purchase made at a distance. If you need help, write to support@apptomi.com.
- If your Unlimited ends: your mini-apps stay on your phone, but you can’t add more past the free limits, and Friends stops.
5. AI services you use
The AI chat apps and AI providers you use with APPTOMI are run by other companies, such as Anthropic, Google and OpenAI. Your use of them is under their own terms and policies, including any limits and charges. APPTOMI is not responsible for their services, their availability, or what they produce. You must also keep to any other agreement that applies to how you use APPTOMI, such as your phone or data plan.
Claude, Gemini, ChatGPT and other names of AI services belong to their owners. We name them only so you know which ones work with APPTOMI. APPTOMI is not affiliated with, or endorsed by, any of them.
6. Mini-apps: who makes them, and the risks
We don’t make them. A mini-app is made by the person who asked for it, with the AI they chose. We don’t write it, don’t see it, and don’t check, test or approve it, and it isn’t ours. The checks APPTOMI runs before a mini-app is added look for technical problems. Passing them doesn’t mean a mini-app is safe, correct, legal or fit for anything.
You are responsible for yours. You are the author of the mini-apps you make, and you are responsible for them and for how you use and share them. That includes what you put in them about other people.
AI gets things wrong. A mini-app can give wrong answers, do wrong sums, lose what you saved, stop working after an update, or do something you didn’t ask for. Check that it does what you expect before you rely on it. You use every mini-app at your own risk.
Never rely on a mini-app, or on APPTOMI, for:
- your health or anyone else’s: medical, medicine or mental health decisions, doses, or diagnosis. Ask a doctor or pharmacist;
- emergencies. APPTOMI can’t call for help. Call your local emergency number;
- safety: watching over a child or a person who needs care, or anything where a mistake could hurt someone. Don’t use a mini-app while driving or doing anything that needs your full attention;
- money, legal or tax decisions, or anything else where a wrong answer costs you;
- alarms and reminders that really matter, such as for medicine or for getting to work. Your phone can stop them: when it is off or out of battery, in silent mode, in battery saving, or after an update. Have a backup.
Flashing lights and movement. A mini-app can show flashing lights, fast movement or loud sounds. A small number of people have seizures or feel unwell from these, even with no history of it. If you or your child feel unwell, stop at once and see a doctor. Take breaks when playing.
What a mini-app can reach. A mini-app you allow can use the phone features and websites you approved for it. It can read, change or delete what it was allowed to, and it can send what it can read to those websites or to people you connect with. Only allow what you are happy with. Data use on your phone plan is yours to pay for.
Mini-apps from other people. A mini-app someone sends you was made by them, not by us. We can’t tell you who really made it, or whether it does what they say. Only add mini-apps from people you trust. Any dispute about one is between you and that person. The same goes for a website a mini-app connects to: it isn’t ours, and we aren’t responsible for it.
What comes with APPTOMI. The sample apps and game kits are examples and building blocks, and sections 9 and 10 apply to them too. The Alarm Clock sample is covered by the warning about alarms above.
The rules. You must not use APPTOMI to make or share anything illegal or harmful, such as malware, apps that spy on people or take their data without consent, scams, or apps that copy someone else’s work or brand. The full rules are in the Acceptable Use Policy, which is part of these terms.
If a claim comes to us because of you. If someone makes a claim against us because of a mini-app you made or shared, or because you broke these terms, you agree to cover our reasonable costs of dealing with it, as far as the law allows.
7. Friends
- Friends lets you chat and share mini-apps with people you add with a code. We can’t read your chats, and we don’t watch them. What people say and send is their responsibility, and we aren’t responsible for it.
- Only add people you know. If someone bothers you, remove them, and report them from your chat with them.
- Friends can stop working, and a message can fail to arrive. Don’t use it for anything urgent.
8. What comes with APPTOMI
APPTOMI, its name and logo, the sample apps, and the pixel art, sounds and other material that come with it belong to APPTOMI or its licensors. You may use them inside APPTOMI, including in mini-apps you make and share. We give you a personal licence, which you can’t transfer, to use APPTOMI on phones you own or control, under the rules of the store you got it from. Open-source parts of APPTOMI are under their own licences, listed in the app.
9. No warranty
APPTOMI, the samples, the kits and mini-apps are provided “as is” and “as available”, without warranties of any kind, to the fullest extent the law allows. We don’t promise that they will be free of errors, safe, accurate, suitable for what you want, or always available. Some countries don’t allow this, so it may not all apply to you.
10. Limitation of liability
To the fullest extent the law allows:
- APPTOMI is not liable for any indirect, incidental or consequential loss, or for loss of data, profit or opportunity, arising from your use of APPTOMI or of mini-apps.
- We are not liable for what a mini-app does or doesn’t do, what someone else made or sent you, or what other companies’ services do.
- Our total liability to you for anything to do with APPTOMI is limited to the amount you paid us for APPTOMI in the 12 months before the claim, or 100 US dollars, whichever is more.
What this doesn’t limit. Nothing in these terms limits liability for death or injury caused by our negligence, for fraud, or for anything else the law doesn’t allow to be limited, or takes away rights you have under consumer law that can’t be taken away.
11. Stopping
You can stop using APPTOMI at any time by uninstalling it. We may change, pause or end APPTOMI, or any part of it, at any time. If we plan to end it, we will try to give you notice, and you can export your mini-apps first.
12. Changes to these terms
We may update these terms. Where changes are significant, we will tell you in the app. Using APPTOMI after a change means you accept the new terms.
13. Problems, law and courts
- Please write to us first, so we can try to fix it. Give us 30 days to answer before you start a claim. This doesn’t stop the clock on any time limit you have.
- These terms are governed by the laws of the State of Israel, and the courts of Tel Aviv have jurisdiction, except where the law of your country gives you the right to bring a claim where you live.
- As far as the law allows, claims are brought by you alone, not as part of a group or class.
- If part of these terms can’t be enforced, the rest still applies.
14. If you got APPTOMI from the App Store
- These terms are between you and us, not Apple. We alone, and not Apple, are responsible for APPTOMI and what is in it. If these terms conflict with the Apple Media Services Terms and Conditions, those win on how you may use the app.
- You may use APPTOMI on Apple devices you own or control, as those terms allow, including through Family Sharing.
- Apple has no duty to maintain or support APPTOMI.
- If APPTOMI fails to meet a warranty that applies to it, you can tell Apple, and Apple will refund what you paid for it. Apple has no other warranty duty for it.
- We, not Apple, deal with any claim about APPTOMI or your use of it, including product liability, claims that it breaks a law or regulation, and claims under consumer, privacy or similar laws.
- If someone claims APPTOMI infringes their intellectual property, we, not Apple, deal with it.
- You confirm that you are not in a country under a US embargo or listed by the US as supporting terrorism, and that you are not on a US list of barred or restricted people.
- Apple and its subsidiaries benefit from these terms, and once you accept them, Apple can enforce them against you.
